Town Justices are elected for a 4 year term
Currently (2010) our Town Justices are:
Marc J. Lust and Ronald B. Bianchi (both last elected 2007)

The Harrison Town Court Sessions are held in the courtroom at the Municipal Building at 1 Heineman Place. Every Tuesday court is in session for Criminal Matters and Traffic Matters. Usually, the first, fourth and fifth Thursday of the month is for Civil and or Small Claim Matters, Violations of Town Ordinances and Traffic Matters. These sessions start at 9:00AM. Court is also in session one (1) Wednesday a month in the evening session starting at 7:00PM for Civil and or Small Claim Matters. Landlord Tenant Matters (Summary Proceedings) are generally held on our Thursday Calendars.

Criminal Matters

The Harrison Town Court hears all criminal cases when the crime has been committed in Harrison. These matters are prosecuted by the Westchester County District Attorneys Office. The jurisdiction for sentencing in a local court is where the maximum sentence is up to one year in jail and the fine up to $1,000.00.

Civil and Small Claim Matters

The Court has jurisdiction in Civil and Small Claim Cases up to a value of $3000.00.
For Civil Matters you or the party you wish to sue must reside or have a place of business in the Town of Harrison. If you reside in Harrison you may sue anyone residing or that has a business in Westchester County. The filing fee for this is $20.00 and the Summons must be served; a Town Constable is available to perform this service for a fee.  This amount is determined by the location of the service.

For Small Claim Matters the party you wish to sue must reside or have their place of business in the Town of Harrison, the fee for filing small claims is based on the amount for which you are suing. For amounts up to $1000.00 the filing fee is $10.00; for amounts greater than $1,000.00 up to and including $3,000.00 the filing fee is $15.00. Service is by First Class and Certified Mail.

Landlord Tenant Matters (Summary Proceedings)

The property location must be in the Town of Harrison.

Filing fee is $20.00 after remitting summons with affidavit of service.

Most, if not all, Summary Proceedings, aka Notice of Eviction, are handled by an Attorney retained by the Landlord.

Town Ordinance Matters

These matters are prosecuted by the Town Attorneys Office and are generally handled on our Thursday calendars.

Traffic Matters

The Violation must have taken place in the Town of Harrison.

There are three (3) options to answer a Simplified Traffic Infraction.

1)      A plea of guilty may be entered and sent by mail and a fine notice will be sent back to you or you may come to our office to respond.

2)      A plea of Not Guilty may be entered with the court by mail or in person and a Pre-Trial conference date will be sent back to you advising you when to appear in court.

3)      Guilty with an explanation may be entered orally before the Judge when court is in session. You should call the court to see when you may be able to come and speak with the Judge.

Traffic Infractions that go unanswered for sixty (60) days after the last adjournment date will result in the notification to the New York State Department of Motor Vehicles which will result in the suspension of your privilege to operate a motor vehicle in the State of New York. Many States are members of a “compact agreement” wherein your license may be also suspended in your home state for failure to respond to your ticket in New York.

Parking Violations

The Violation must have taken place in the Town of Harrison.

There are also three (3) options to answer a Parking Summons.

1)      A plea of guilty may entered along with payment either by mail or in person or if you received an electronic parking summons you may pay on the website on the back of the summons by credit card.

2)      A plea of Not Guilty may be entered with the court by mail or in person and a Pre-Trial conference date will be sent back to you advising you when to appear in court.

3)      Guilty with an explanation may be entered orally before the Judge when court is in session. You should call the court to see when you may be able to come and speak with the Judge. 

Parking Violations that go unanswered will incur additional penalties. The fine will double after thirty (30) days, and will triple after sixty (60) days. Additional penalties will accrue thereafter. Also, with the cooperation of the New York State Department of Motor Vehicles, the court is able to designate as “Scofflaw” a person with three (3) or more outstanding parking summonses acquired within an eighteen (18) month period and New York State Motor Vehicles will be able to prevent you from registering your vehicle. Other serious consequences may occur (Harrison Police Department may “boot” your vehicle).

 Payment Options

The Court will only accept cash, money orders, certified checks and now credit cards (Visa, MasterCard & Discover). If a personal check is sent in it will be sent back and if payment is not made by the date due repercussions will follow (see above).

Exception: Personal Checks will only be accepted on Current Parking Infractions. Once any penalties have accrued no personal checks will then be accepted.
