CAL. Z12-023   NICHOLAS LAPETINA – 124 Harrison Avenue, Block 93, Lot 23 – This property is located in a B Zoning District and pursuant to §236-9 (B) of the table of dimensional regulations of the Zoning Ordinance of the Town/Village of Harrison the minimum required habitable floor area for each dwelling unit is 1,200 square feet. This application requires 2 variances. 1: The first floor apartment is indicated to have a total habitable floor area of 943 square feet thus requiring a variance of 257 square feet. 2: The proposed second floor apartment is indicated to have a total habitable floor area of 885 square feet thus requiring a variance of 315 square feet.

CAL. Z12-024   ANTHONY & EILEEN CARABALLO – 27 Stonewall Circle, Block 1002, Lot 29 – This property is located in an R-1 Zoning District, the property is located in a cluster development with a minimum lot size of .5 acres and conformance with the R-1 setback requirements. As per §235-28(A) Swimming pools within the B, R-75 and R-50 district, no swimming pool shall be located within 10 feet, or within any other district, no swimming pool shall be located within 20 feet of the side and rear yard property lines nor shall be setback less than 60 feet from any street in the B, R-75 and R-50 district, and 75 feet n all other districts. Also as per §235-31(A) Except in the R-75, B and MF Residence Districts and in the PB, NB, CBD and MFR Business Districts, all buildings and structures shall be setback at least 50 feet from seasonal high water level water’s edge or established channel lines of streams and other water bodies, as established by the Town Board. Where such lines have not been established by the Town Board, reference shall be made to those established by other governmental bodies such as the State, the County, the Soil Conservation Service of the United States Department f Housing and Urban Development, Federal Insurance Administration. This application requires 2 variances: 1:The proposed pool is shown to have a setback of 10 feet from the rear property line, therefore a variance of 10 feet is required. 2: The pool is setback approximately 30 feet from a body of water located at the rear of the property therefore a variance of 20 feet is required.

CAL. Z12-025   ANTHONY & VICTORIA DIBIASI – 170 Park Avenue, Block 892, Lot 8-9-10 – This property is located in a B Zoning District and pursuant to §235-18 B3 Accessory off-street parking spaces, other than those which might be incidentally available within the actual driveway area, shall not be located within any front yard or required side yard or within 10 feet from any property line in a required rear yard. The variance sought is for off-street parking in the front yard.

CAL. Z12-026   JIMMY & DANIELLE GOULAS – 1 Old Lyme Road, Block 703, Lot 47 – This property is located in an R-1/3 Zoning District and on the corner of Anderson Hill Road and Old Lyme Road and pursuant to §235-24.1 (B) of the Zoning Ordinance of the Town/Village of Harrison Titled Buffer setbacks along roadways in Purchase. A minimum buffer setback of 100 feet shall be established along each of the following roadways: Purchase Street, Barnes Lane, Lincoln Ave, Cottage Ave and Anderson Hill Road. This setback shall be maintained in its natural state or landscaped in accordance with the determination of the Planning Board, and shall be maintained by the property owner. Except where approved street or streets cross such buffer setback areas, a permanent open space preservation easement may be required by the Planning Board prior to the granting of any building permit for any development abutting any of Purchase Street, Barnes Lane, Lincoln Ave, Cottage Ave and Anderson Hill Road. The proposed wall is shown to have a setback of approximately 11 feet from the property line along Anderson Hill Road; therefore a variance of 89 feet is required.  Planning Board has already granted Site Plan Approval.
