A. REPORT FROM SUPERVISOR DIONISIO ON DECISIONS MADE FOLLOWING TOWN BOARD MEETING HELD ON JUNE 15, 2023

1. Authorization of the purchase of 2 dispatch consoles for the HPD in the amount of $52,938.99.

2. Authorization to appropriate Town Fund Balance, transfer out to the Capital Fund and place funds within Capital Account 15PO14. The funds will be used towards the purchase of equipment for the Police Department.

3. Authorization of the purchase of Digital Recorder for the radio system and phone lines at the HPD in the amount of $21,883.50.

4. Authorization of the purchase radio equipment for the HPD in the amount of $353,375.36.

5. Authorization to suspend Frank Direnno from the Department of Public Works for 30 work days starting June 16, 2023.

6. Authorization to promote Dominick Cianci (DJ) to Senior Auto Mechanic in the Equipment Maintenance Division, effective June 6, 2023 at an annual salary of $98,273.00.

7. Authorization to raise cap on legal fees to $40,000 to Ira Levy, Esq.

8. Authorization to raise cap on legal fees to Katten, Muchin, Rosenman, LLP for the Safe Drinking Water Act Investigation to 50,000.

9. Authorization to raise cap on Legal Fees to the Law Office of Vincent Toomey to $60,000.

10. Authorization of the provisional hire of Catherine Tammaro as Director of Community Services, retroactively to Monday June 12, 2023 with an annual salary of $75,000.

11. Authorization to settle the matter of the United States of America v. Town/Village of Harrison, in the amount of $425,000.00.

12. Authorization to pay outstanding Legal Fees in the matter of the United States of America v. Town/Village of Harrison.

13. Authorization to hire Barbara Reames as a Part-Time Civilian Employee in the records division at the Harrison Police Department at an hourly rate of $44.15 per hour, effective immediately.

14. Authorization of the probational hire of, Jack Aiello, as a Senior Office Assistant, Office Manager, in the Engineering Department, effective June 19, 2023 with an annual salary of $69,153.00.

15. Authorization to pay Louis DiBuono a Stipend of $12,000 per year.

18. Authorization to make a conditional appointment of Gregory D. Lucien as a Police Officer, at an annual salary of $49,384.00.

C. PUBLIC HEARING

1. Request by, Supervisor Dionision, to accept and file the Negative Declaration pursuant to SEQRA for the Proposed Local Law amending Section 71(B)(1) of Chapter 235, entitled "Zoning" of the Town Code of the Town of Harrison.

2. A) Request by, Supervisor Dionisio, to accept and file the Negative Declaration Pursuant to SEQRA for proposed Local Law Amending Chapter 235 to create a new zoning district known as GC-RF – General Commercial-Residential Floodplain District.

B) Public Hearing for Proposed Local Law Amending Chapter 235-17, by adding Section CC, creating a GC-RF Zoning District and amending Attachment 3, entitled “Business Districts: Table of Use Regulations” and Attachment 4, entitled “Business Districts: Table of Dimensional Regulations”.

 

D. PERSONNEL

1. Request by, Personnel Manager, Debra Scocchera, to approve the following list of Recreation Attendants and Life Guards for the 2023 Camp Season:

E. ACTIONS AND RESOLUTION

1. Notification by, Superintendent of Recreation, Gerry Salvo, that the Citizen of the Year Committee is now taking nominations for 2023 Citizen of the Year Award to be presented at the “It’s Great to Live in Harrison Day” Celebration/Columbus Day Observance, scheduled for October 9, 2023. Nominations must be received by August 31, 2023 to Gerry Salvo.

2. Request by, Village Attorney Jonathan D. Kraut, for the authorization of the Agreement between the Town/Village of Harrison, the County of Westchester Industrial Development Agency, BCE NY Solar One and MS Harrison, LLC. The Agreement has been reviewed by the Law Department and deemed it to be in order and accordingly recommend authorization for the Supervisor/Mayor to execute the same.

3. Request by, Building Inspector, Rocco Germani, for the reimbursement to Suzanne Fuller for the enrollment in a course at Southern New Hampshire University, totaling $1,910.63.

4. Request by, Building Inspector, Rocco Germani, for the approval of a Special Events permit for Calvary Fund, Inc. to hold 35th Annual Golf & Tennis Classic at the Brae Burn Country Club in Purchase, NY on July 24, 2023. Further request to have the Special Events permit fee waived. A pre-event conference must take place with the Harrison Police Department. 

5. Request by, Town Engineer, Michael J. Amodeo, to accept the 2022-2023 Storm Water Annual Reports that will be submitted to NYSDEC.

6. Request by, Village Attorney, Jonathan D. Kraut, to schedule a Public Hearing for Proposed Local Law Amending Chapter 54, entitled “Residency Requirements” on August 10, 2023.

7. Request by, Village Attorney, Jonathan D. Kraut, to schedule a Public Hearing for Proposed Local Law Amending Chapter 235-17, by adding Section CC, creating a GC-RF Zoning District and amending Attachment 3, entitled “Business Districts: Table of Use Regulations” and Attachment 4, entitled “Business Districts: Table of Dimensional Regulations” on August 10, 2023.

8. Request by, Comptroller, Maureen MacKenzie, to approve the Agreement between the Town of Harrison and the County of Westchester on behalf on the Harrison Youth Council in the amount of $3,826.00. The Agreement had been reviewed by the Law Department and found to be in order. Further request for the Supervisor to execute the agreement.

10. Request by, Chief of Police, John T. Vasta, to participate in the LightPath Service Agreement, with terms to agree to the 60-month, 20 Mb e-Lan service order which provides data between MTA MRRS and Zetron consoles. Further request for the Supervisor to sign the agreement once the Law Department deems it to be in order.

11. Request by, Chief of Police, John T. Vasta, to participate in MTA MRRS User Agreement as a level II, Full System Agency User. This agreement is between the Metropolitan Transportation Authority (as represented by the MTA Police Department – “MTAPD”) and the Town/Village of Harrison (as represented by the First Responder Agency – “Harrison Police”). This agreement is for the purpose of supporting the MTAPD and partner public safety and public service agencies. MRRS is owned and operated by MTAPD and is to be used by the First Responders only for the purposes of supporting public safety. Further request for the Supervisor to sign the agreement once the Law Department deems it to be in order.

12. Request by, Deputy Village Attorney, Andrea C. Rendo, to approve the proposed School Resource Officer (SRO) Agreement between the Town/Village of Harrison and the Board of Education of the Harrison Central School District, covering the September 1, 2023 through June 30, 2024 school year. The Agreement has been reviewed by the Law Department and deems it to be in order. Further request for the Supervisor to execute the document.

13. Request by, Century Country Club General Manager, John Tieng, to hold 125th Anniversary Fireworks Display on the club grounds (233 Anderson Hill Road) on September 3, 2023 with a rain date of September 4, 2023 at approximately 7:45 PM. Further request for the Purchase Fire Department and the Harrison EMS standby during the display. Insurance will be submitted. This requires the approval by the Acting Fire Marshall and the Chief of Police.

14. Request by, Comptroller, Maureen MacKenzie, for the renewal of the contract with TRAIDGROUP, L.L.C., AS OUR Third Party Administrator (TPA) for our self-insured Workers Compensation claims. The previous contract ran from April 1, 2020 through March 31, 2023, with the following annual administration fees. Year 1 $56,500, Year 3 $58,000. The fees for the term of this contract are as follows: Year 1 $58,000 Year 2, $60,000 and Year 3, $60,000. This is a budgeted item and funds for this contract are available in budget line 001-1900-100-4407, Town Fund, Special Items, Special Services. Further request for the Supervisor to execute said contract after review by the Law Department.

15. Request by, Superintendent of Recreation, Gerry Salvo, for the approval to enter into an agreement with Sesac Music Performance for Municipalities as per the Law Department. This will be a yearly agreement with Sesac in the amount of $1,104.00. Funding is available in account #001-1900-100-4407.

16. Request by, Director of Community Services, Catherine Tammaro, to accept the following donations for the Harrison Food Pantry:
